Definitions

- Customer: The person or their representative who places an order for goods or services with the Supplier. The Customer must have legal capacity to contract (no minors or those unable to contract).
- Commencement Date: The date the Supplier receives the Customer’s first payment.
- Contract: These standard terms and conditions of sale.
- Delivery Date: The agreed time and date for delivery of goods and services, which may be changed by the Supplier with prompt notice to the Customer.
- Goods: The products the Supplier provides to the Customer under these terms.
- Services: The services described on the Supplier’s website.
- Supplier: Janblok
- Website: The Supplier’s website at www.janblok.co.za
Basis of Sale and Service

- By placing an order (online or otherwise), the Customer is making an offer to buy goods and/or services from the Supplier.
- The Contract is formed when the Supplier receives proof of payment from the Customer.
- This Contract is not the result of direct marketing, but of the Customer’s own initiative.
- Any changes to the Contract must be agreed to in writing by both parties.
- By ordering or signing up on the Website, the Customer agrees to receive marketing and other communications from the Supplier, even outside normal business hours.
- The Supplier may correct any accidental errors in documents or communications without liability.
- The Supplier may cancel an order if necessary, in which case only payments already made for that order will be refunded.
Goods and Services

- Images and descriptions on the Website or in brochures are for guidance only; only the specific goods ordered are guaranteed.
- The Supplier may change product specifications to comply with safety or legal requirements, or if the changes do not significantly affect quality or performance.
- The Supplier is not responsible for delays caused by unforeseen events (e.g., strikes, weather, power outages) or by the Customer. The Customer will be informed of any such delays.
- Product availability is limited. The Supplier will update the Website as soon as possible when items are out of stock. If a product is sold out after an order is placed, the Supplier will refund the Customer.
- The Supplier is not responsible for the Customer’s intended use of the goods unless specifically informed.
- The Supplier is not liable for theft, loss, or damage to the Customer’s property unless caused by the Supplier’s recklessness.
Price

- The price is as shown on the Website at the time the order is accepted.
- The Supplier may increase the price before delivery if costs rise due to factors beyond their control (e.g., currency changes, increased material costs), or if the Customer requests changes.
- Unless otherwise stated, prices include packaging and transport.
- Prices include VAT (currently 15%).
- Standard delivery is free for orders of R1,500 or more within South Africa. Other orders have a flat delivery fee of R150. Outlying areas may have extra charges or delays (the Customer will be informed before dispatch).
Payment

- Payment timing is essential. If the Customer does not pay on time, the Supplier is not bound by the transaction.
- Payments must be made using the Website’s payment options.
- The Supplier checks all transactions for fraud and may refuse a transaction if it seems suspicious. The Customer will be notified if this happens.
Delivery and Performance

- Subject to availability and full payment, goods will be delivered by the Supplier’s contractor to the address specified by the Customer in South Africa.
- The Supplier or courier will inform the Customer of the expected delivery time, but is not liable for delays beyond their control.
- If the Customer does not accept delivery after reasonable attempts, the goods will be held for 8 weeks, after which they may be disposed of.
Ownership, Care Instructions, and Product Recall

- Ownership of goods passes to the Customer only after full payment is received.
- Customers should follow care instructions on the Website.
- In the event of a product recall, the Customer agrees to help the Supplier recover affected goods.
Warnings and Instructions

- Be careful when unwrapping and disposing of packaging. Keep packaging away from children and vulnerable people.
- Use scissors to open packaging. Packaging is not edible and may be dangerous if swallowed.
- Use goods responsibly to avoid injury. Rugs should have anti-slip underlays on slippery surfaces.
- Keep goods dry (except towels in use). Wet goods may stain other materials.
- Take precautions against fire where goods are used or stored; some goods may be flammable.
Returns
a. Cooling-Off Period – Returns within 7 Days

- Under Section 44 of the Electronic Communications and Transactions Act, you may cancel an online order before dispatch or return items within 7 days of receipt, provided they are unused and in original packaging. A collection fee applies.
- To return, email onlineorders@hertex.co.za within 7 days, include photos of the original packaging, and arrange collection.
- Refunds or exchanges are processed after items are received and checked. Refunds may take up to 14 working days.
- Some goods cannot be returned (e.g., customized items). Contact us if unsure.
b. Returns or Exchanges within 30 Days

- Most products can be returned within 30 days of delivery. Handling and collection fees apply unless the item is faulty.
- Email onlineorders@hertex.co.za within 30 days, include photos of the original packaging, and arrange collection.
- Refunds or exchanges are processed after items are received and checked.
c. Incorrect Items Received

- If you receive the wrong item or quantity, email onlineorders@hertex.co.za immediately (within 30 days). We will correct the error.
d. Faulty or Damaged Items

- If you receive a faulty or damaged item, email onlineorders@hertex.co.za immediately (within 30 days), include photos, and arrange collection.
- If the item is found to be faulty, we will offer a replacement or refund.
- Items altered after delivery cannot be returned or exchanged.
Liability

- Except for harm caused by the Supplier’s gross negligence, the Supplier is not liable for any damages, losses, or expenses related to the supply of goods or services.
Force Majeure

- If either party cannot fulfill their obligations due to events beyond their control (e.g., war, natural disasters, strikes), they are not in breach of contract. They must notify the other party and try to resume performance as soon as possible.
- If such events last more than six months, the contract ends unless both parties agree otherwise.
Waiver

- If the Supplier waives a breach of contract, it does not mean future breaches are also waived.
Severability
-
- If any part of these terms is found invalid or unenforceable, the rest remains in effect.
Governing Law and Jurisdiction

- This contract is governed by South African law (unless the Customer orders from abroad).

- Discount codes are for your personal use, valid for your first online purchase during the specified period, and cannot be combined with other discounts or used on sale items. Codes are for online use only and require you to be logged in.

Dispute Resolution

- Any disputes will be settled by arbitration at the Cape Town offices of the Arbitration Foundation of South Africa (AFSA), unless urgent legal action is needed. The arbitrator’s decision may be made an order of court.
